Terms of Service

Depth is open-source software you install on your own machine. These terms set out the basic agreement between you and the Depth contributors when you install, use, or interact with the extension or the marketing site. We've kept them as short and plain as we can while still saying what needs to be said.

The short version

Use Depth however you like, within the law and within the terms of Depth Hosted (the default backend) and any other model provider you connect it to. The software is provided as-is, with no warranty. We're not responsible for what the model says, for third-party fees you incur in bring-your-own-key mode, or for what you do with the output. Paid Depth Hosted tiers are governed by the cancellation and refund terms in section 3. If you can't agree to that, don't install the extension.

01Acceptance

By installing the Depth Chrome extension or using the site at depth.microfalls.com, you agree to these Terms of Service and to the Privacy Policy. If you are using Depth on behalf of an organization, you represent that you have authority to bind that organization to these terms.

02The Depth software

The Depth extension is open source and distributed under the MIT License. A copy of the license ships with the source code. You receive whatever rights the MIT License grants you with respect to copying, modifying, and redistributing the software. These Terms of Service govern your use of the official builds we publish — the source license governs the code itself, and the two do not conflict.

Updates

The Chrome Web Store may push extension updates automatically. We may modify, add, or remove features between versions. Major changes that affect data handling will be reflected in the Privacy Policy and surfaced in-app.

03Your account, your usage, and your keys

Depth runs in two modes. The default is Depth Hosted; you can switch to bring-your-own-key in Settings.

Depth Hosted (default)

On first use, the extension creates an anonymous account on Depth Hosted so we can route generation requests for you. The free tier includes a daily quota of generations; when you exceed it, the panel surfaces an upgrade prompt and pauses generation until the next day or until you upgrade. You may at any time sign in with Google to convert the anonymous account into a permanent one, and upgrade to a paid tier via Stripe.

For paid tiers, fees are billed in advance for each period, are non-refundable except where required by law, and renew automatically unless you cancel through the account-management links surfaced in the extension. You can downgrade or cancel at any time; access continues through the end of the current paid period and then reverts to the free tier. We may change the pricing, quota, or feature mix of any tier on at least 14 days' notice for the next billing period; existing paid periods are unaffected by mid-cycle changes.

Bring-your-own-key

In BYO mode, you supply your own API key for a supported third-party model provider and the extension talks to that provider directly. Depth Hosted is not involved. You are responsible for:

05Model output

The summaries, quizzes, and Socratic responses Depth surfaces are generated by third-party language models in real time. They may be inaccurate, incomplete, biased, or out of date. Treat them as drafts to be checked against the original article, not as authoritative statements of fact. Depth does not author the model output, does not pre-screen it, and cannot be held responsible for what a given model says on a given day.

You retain whatever rights the source content and the model provider's terms grant you over the generated output. We claim no ownership of anything the model produces in response to your requests.

06Third-party services

Using Depth involves several third-party services, each with its own terms:

We are not responsible for the availability, content, or behavior of any of these services, and your use of them is governed by their respective agreements. We choose sub-processors carefully but cannot guarantee they will be free of outages, errors, or policy changes.

07Intellectual property

The Depth name, wordmark, and visual identity belong to the Depth contributors. The source code is MIT-licensed. The marketing site's copy, layout, and images are © 2026 Depth contributors and provided for personal reference under CC BY-NC 4.0 unless otherwise noted. Nothing in these terms grants you a trademark license; if you fork the source and ship a derivative product, please pick your own name.

Copyright complaints (DMCA)

If you believe content published on depth.microfalls.com/community infringes your copyright, please send a takedown notice to our designated agent at support@microfalls.com with the subject line "DMCA Notice." The full notice-and-takedown procedure, the elements a notice must contain, and the counter-notice process are described on the Copyright & DMCA Policy page. We hide a reported summary promptly on receipt of a valid notice and terminate repeat infringers.

08Disclaimer of warranties

The Depth extension, the marketing site, and any related services are provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Depth will be uninterrupted, error-free, or that it will produce accurate, complete, or current results.

09Limitation of liability

To the maximum extent permitted by law, the Depth contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or in connection with your use of Depth — including model output, third-party API charges, or downtime of any third-party service. Our aggregate liability for any direct claim is limited to the greater of (a) the fees you paid us for Depth Hosted in the twelve months preceding the claim and (b) USD $50. If you use Depth only on the free tier or only in bring-your-own-key mode, our aggregate liability is capped at USD $50.

10Indemnification

You agree to indemnify and hold harmless the Depth contributors from any claim, demand, loss, or expense (including reasonable attorney's fees) arising out of your use of Depth in violation of these terms, any applicable law, or any third party's rights.

11Termination

You may stop using Depth at any time by uninstalling the extension or removing your saved data through your browser's controls. We may discontinue the extension, the marketing site, or any feature at any time, with or without notice. Provisions that should reasonably survive termination — license, intellectual property, disclaimers, limitations of liability, indemnification — will do so.

12Governing law

These terms are governed by the laws of the jurisdiction in which the Depth contributors reside, without regard to its conflict-of-laws rules. Disputes that cannot be resolved informally will be brought in the competent courts of that jurisdiction, except where mandatory consumer-protection law in your country of residence provides otherwise.

13Changes to these terms

We may update these terms from time to time. When we do, we'll change the "Effective" date at the top of this page and, for material changes, surface a notice in the extension before they take effect. Continued use of Depth after the new effective date constitutes acceptance of the revised terms.
